In Jamaica, having a legal identity is becoming more and more of a necessity to carry out business with both the private sector and the public sector. Persons are unable to apply for jobs and open bank accounts among other things, as they are undocumented, which further results in them being denied opportunities and possibilities for personal growth and development.


On Tuesday, December 15, 2020, Prime Minister, the Most. Hon. Andrew Holness tabled the National Identification and Registration Bill, 2020, which makes provisions for a voluntary and secure National Identification System (NIDS) for Jamaica. This Bill seeks to establish a National Identification System (NIDS) which will result in the institution of a unique secure method of ascertaining that an individual's identity is genuine. Persons will voluntarily register under the NIDS and will be issued with a National Identification Number (NIN) which will be their unique identifier in the system. Additionally, all information captured through registration for a NIN will be stored in a secure database. The use of a NIN as the primary key will enable interconnectivity of the NIDS database and all records within existing GOJ databases.


Some Jamaicans are very sceptical of this Bill as some persons believe that once this becomes an Act of Parliament, the Government of Jamaica will have their data captured and other information available to use against them, know their every move and take away their right to privacy. Some agree that it should not be mandatory to register and obtain a National Identification Card. Others say that the advantages outweigh the disadvantages and for there to be an efficient operation of NIDS to enable it to meet its objectives, every citizen and ordinary resident of Jamaica must be mandated to be registered.


NIDS-A Lifesaver or an unwanted guest?


Research the NIDS policy and review the 2020 NIDS Bill. Your research should include the following:


a. An Introduction with an overview of the NIDS policy.


b. An explanation of the Objectives of the NIDS Bill.


c. The role and four (4) functions of the Body Corporate and the Office established under the Body Corporate.


d. The explanation of two (2) advantages and two (2) disadvantages of the NIDS system.

my wife is in jail she has a bond I have the money for the bond but when I met him at the jail he called for her face sheet he took the money then said they were unable to release her to the next day he gave me the money back said we will call in the morning and see what happen why would they not release her if she has a bond I have the money to pay for it through an bondsman

BUSINESS LAW - CONTRACT

On February 7, Derrick posted two separate letters to Bert and Andy and informed 

them that he was selling his 50 inches Surround Sound television set for $300,000. 

He stated that they should respond by post and that the offer would remain open 

until the 14thof February. Both persons received the letters in the post on the 

following day.


Andy on receiving the letter thought it was a good price. He immediately called 

Derrick stating that he was interested in buying the television set but he wanted to 

see it first. However, he was too busy with work and on February 10, he posted a 

cheque for $500,000.00 to Derrick. He also informed him in the letter that he would 

come and collect the television set on February 16.


Immediately Bert received the letter, he telephoned Derrick, but he was not around 

to take the call, so he left a message on Derrick’s answering machine stating that in 

his opinion the television set was overpriced and he would pay $200,000 for it. 

Derrick retrieved the message on February 11 from his answering machine. He 

received a call one hour later from Bert stating that he would purchase the television 

set for the $300,000 as he just realized that it had surround sound and picture in 

picture. Derrick told him that he would not sell it to him. Bert is insiting that he has

made a valid acceptance and will sue him.


Meanwhile not hearing from Andy on the 12 the day of February, Derrick advertised the television set for sale in the newspaper to see if he could get a higher price. Derrick was visited by John on the 13th February, who responded to the Ad. John 

told him that he was the famous actor “Johnny B”, showed him his identification 

and gave him a cheque for $400,000 and left with the television set. On lodging the 

cheque, later that day, Derrick discovered that there was no such account and that 

Johnny B was a wanted crook. Derrick was embarrassed and did not report the 

matter to the police. The next day, after getting a tip from one of his friends who he

had told what had happened, he went to a pawn shop located near his home and 

saw the television set on a stand. The owner of the Pawn shop, Paul, told him that 

on the 13th February, a man came in and sold it to him for $200,000. 


Derrick received the letter with the cheque from Andy on the 15th February and 

Andy visited him as he stated he would, on February 16. He told Andy that he did 

not have a valid acceptance as he should have received the letter by the 14th

February. Andy is quite upset and has informed Derrick that he will sue him. 


Derrick also informed you that he sold a 17 year old University student Crissy a12 

inch Samsung notebook for $50,000.00 on credit of $10,000 per month but she has 

only made one payment. Her best friend Mary who had accompanied her to 

Derrick’s store did mention to Derrick that Chrissy had a brand new laptop and a 

one year old notebook so she did not need it, however he decided to still sell her.


Derrick wants to know if he can sue Paul to recover the television set and if Andy 

or Bert will be successful if they sue him. He also wants to recover the outstanding 

payments from Chrissy as these are all overdue.


1). Advise Derrick on all issues arising.


BUSINESS LAW - CONTRACT


Michelle decided to treat herself for her birthday and checked into “The Ritzzy

hotel”. She signed a contract which she never read, with one of the terms being 

that the hotel will not be responsible for any car that has been parked in the 

hotel’s parking lot which is damaged or stolen.

Upon arriving in the room, Michelle saw a sign on the bedroom wall informing 

her that the hotel is not liable for any items missing or stolen from the room. All 

valuables were to be taken by guests when leaving the room..

Michelle left her genuine pearls in the room and went to dinner. Upon her return 

to the room her pearl set was gone. The hotel was informed by Michelle of the 

theft, however they denied liability based on the sign in her room. Michelle 

decided to leave the hotel and was quite outraged when she went to the car park 

and saw that her tyres were all slashed.

The hotel is also stating that it is not liable for the slashed tyres. Michelle wants to 

sue them to recover the costs for her pearls and the slashed tyres.


1). Advise Michelle.


The following statement can be seen as an important element of the contextual approach to statutory interpretation.


(1) The interpretation process cannot be complete until the object and scope of the legislation are taken into account.

(2) If the meaning of legislation is clear, it should be equated with the intention of the legislature.

(3) The court should interpret legislation only within the framework of the words in the legislation.

(4) Words must be given their ordinary grammatical meaning.


Albert Camus, Noah Avram Chomsky, Woodrow Wilson, Elton Mayo, Frederick Taylor and Meredith Spencer together with their management consultant Etsey Agbenorxevi recently returned to Ghana for a holiday. It was during this same period that the COVID-19 pandemic hit the world hard to the extent that nations closed their borders. Having remained in Ghana for the past 8 months, they have become very accustomed to the culture of Ghana and have decided to move their investments from the diaspora to Ghana through the vehicle of business organisation here in Ghana. Upon a visit to the University of Ghana last week Thursday, they met you at the athletic oval and begun to discuss their intentions with you 


a) As a Company Law student who is very ardent and meticulous in whatever you do, discuss with them the types of business organisations there are in Ghana and why they should go for a particular business organisation and not the other.


b) Following your counsel in A above, they want to know all that there is about the concept of Directors of a company and to whom they owe their duties
