come to their attention that their product X which they are selling under the trade
mark ABC is the same product that their competitor, company B, is selling and that
company B has recently registered the identical trade mark ABC. Advise A briefly
what their position is, in terms of the Act (-on these facts alone).
In the case where a firm has been registered with an identical trade mark as company A, the firm can seek legal intervention of the case following the provision of the Lanham Act. According to this Act, which was established in 1946 and recently amended in 1996, protects companies from identical trade marks. The source of trademark protection would help company A to sue or seek legal intervention of the newly registered organization
