a)    A contract of agency can be expressed or implied from certain circumstances and conduct of parties. Explain agency by implied appointment and agency by necessity. Provide examples to support your explanation.


b)   Binda engaged Natrah to burn Samuel’s car and agreed to indemnify Natrah against all consequences of the act. Acting upon this agreement, Natrah burnt Samuel’s car. Samuel successfully sued Natrah for damages amounting to RM30,000 which Natrah promptly paid. Natrah wants to recover from Binda the RM30,000 and her legal expenses incurred when defending the suit.

 

Advise Natrah based on law of agency that you have learnt.



a)    Impossibility of performance of a contract covers two situations that are impossibility at the time of a contract is made and impossibility after it has been made. Discuss what is impossibility after the contract is made and circumstances under which a contract may be discharged by supervening impossibility.


b)   In cases of breach of contract, the innocent party may claim remedies from the other party. Explain in detail the remedies available for the innocent party according to the Contracts Act 1950.
