Explain the difference between “duress” and “undue influence” and provide an example of each.
Duress is forcing an individual through wrongful pressure to get into a contract that they would ordinarily refuse. For instance, an individual is held at gunpoint and forced to drive their car at high speed. On the other hand, undue influence is when an individual applies their power position to induce another person to get into a contract. For instance, in the case where the victim mainly depends on the abuser.
