Jose and "C" Insurance Company agreed on an accident clause whereby the Insurance Company will pay any victim of Jose thru accidents. Jose later accidentally ran over Maria. Maria asked for the payment of the insurance contract. hence under the principle of Mutuality of Contracts, she cannot ask for any payment from the insurance. Is Jose correct? Explain.
