Amandla Workers (‘AW’) is a recently registered trade union with members in Diamond Miners (Pty) Ltd (‘DM’). Umbrella Workers Association (‘UWA’) is another trade union with members in various mines, including at DM. AW approaches you as a collective labour law student to give the union advice on a number of matters.

Advise AW on the following:

the meaning of collective bargaining; and

whether AW and its members can be bound by a collective agreement concluded between UWA and DM.
