Criminal law question. John a driver for a school was asked to drive the school bus to town to collect some books which were donated to the school library. without check the road worthiness of the bus, he set out on his journey. Whilst driving, he took some unauthorized passenger and was talking on the phone with only one hand on the steering wheel, nearing to a checkpoint, driving above the speed limit, the vehicle had a flat tire which caused it to somersault killing one of its passengers. you are asked to advise the bereaved family as to who should be held liable John, the school, or both
