The roman civil process in the 2^nd century BC was divided into two stages; namely before the magistrate (in iure) and before the judge (apud iudicem). At the second stage iudex was appointed to conduct the hearing. The iudex was a private person taken from the higher social classes. No special legal knowledge was required. The choice of the judge lay with the parties and was normally, but not necessarily, made from a panel of qualified persons. The choices made by the parties was approved by the magistrate (the person whom the in iure proceedings wre conducted.) The appointment to be iudex was inescapable unless under special occasions .
