How can the principles of Ubuntu be applied in the criminal justice system to ensure justice for victims? (200 words, 5 marks)
The values of Ubuntu provide a sense of interrelation that highlights the need for equality, unity and justice in society. Under Ubuntu values, lawyers must understand the ability they have to make, to defend the interests of poor citizens & influence public policy on a daily basis. It is the 1st phase of criminal justice for the police, Ubuntu is important when dealing with a suspect. The " law enforcement officers" must understand that they are dealing with someone who are like them in "their nature" and they must hence handle any suspect so as to protect their "dignity", which is one of the core concepts of "Ubuntu." And it is the second phase for the "judiciary functionary" for all participants in the trial system. Ubuntu acknowledges the "common links", the "sense of inter-connection” between "humanity" & encourages them to use their legal know-how on a day-to-day basis to "promote" social good & pursue "humanitarian goals". Ubuntu., hence draws on a "relational view.’’ The punishment must represent the morale of the community that is ready by reconciliation to rehabilitate with the community. It highlights Ubuntu's sensitivity and humility and our courts must uphold the philosophy by returning the chance of the offender being reconciled with the community.
