In case Aluminum was the limiting reagent then the procedure would ask to use less aluminum foil and greater amount of copper (II) chloride dihydrate. In the reaction experimenter would be able to tell that copper (II) chloride dihydrate is an excess reagent, because he would see unreacted copper (II) chloride dihydrate in the solution. He also will be able to tell that aluminum is the limiting reagent, because there would be no aluminum left in the solution.
