Question #130978

Explain the difference between authoritative and persuasive sources of law

Expert's answer

An authoritative source of law confers authority on the decision-maker to select and interpret the rule. Such sources take precedence over other sources of law. Conversely, persuasive sources of law are consulted by the court when deciding a case, but the court does not apply when reaching the final conclusion of a case.
