Why is it important that the rulings of the European Court cannot be repealed by EU
member states?
The European Court of Justice ensures EU law is interpreted and applied the same way in all EU member countries and settles disputes between EU institutions and national governments. The Court of Justice is the supreme guardian of Union legality and its rulings are therefore legally binding to all member countries. It's important that the rulings of the European Court of Justice cannot be repealed by EU member states so as to ensure their faithfulness to the Union's basic principles of democracy and the Rule of Law. If the European Court of Justice's decisions are to be repealed by EU member states, the Union would crumble as national governments would fail to meet their obligations under the Treaties.
