Critically discuss whether EU law strikes the right balance between the creation of an internal market in goods on the one hand and other public interests such as public security or protection of the environment on the other hand.
According to Article 26 TFEU, internal markets is an area without internal frontiers in which free movement of goods, persons, services and capital is ensured in accordance with the treaty’s provisions. However, while EU law provides for such freedom, there law does not define how the internal market should be shaped, the EU regulation intensity, the public interests such as health, safety, and environmental protection. Therefore, the EU law does not strike the right balance between the creation of internal market and other public interests such as public security and environmental protection.
